Haversham Club Rules (2000)

  1. Notice: As in accordance with the Charter, the Haversham Club Board of Trustees has adopted these rules. Each property owner in Haversham is considered to be on constructive notice of all rules of the Haversham Club, and is responsible for the communication and enforcement of these rules to his/her family, friends, and guests. A copy of these rules shall be provided to each property owner in the Haversham Addition, and a copy shall be placed in the Clubhouse.
  2. Purpose: These rules have been adopted in the best interest of, and for the benefit of, The Haversham Club and its members. Please make every effort to voluntarily abide by these rules. To do otherwise creates unnecessary and embarrassing situations that can be otherwise avoided. If you are asked by a member of the Board or any other member to follow these rules, please do so without the need for other action by The Haversham Club.
  3. All violations of these rules can be reported to the Haversham Club Board of Trustees. A member who violates these rules or provisions of the charter of the Haversham Club or Deed Restrictions of the Haversham Addition to the City of Lubbock is no longer “in good standing,” and may lose rights of access and use of the Clubhouse and pool for a time as to be determined by the Board of Trustees.
  4. No parking whatsoever is permitted on the drive, which runs from Flint Avenue up to the Clubhouse. This is to be used for services only. The space next to the Clubhouse is for the caretaker only. No guest of Haversham Club members using the Clubhouse or pool (pool, as used in these rules, shall mean the pool and the pool area) shall park in the drive running from Flint Avenue up to the Clubhouse.
  5. All reservations for the Clubhouse must be made by an Adult property owner of a lot in  Haversham (or, if the owner does NOT live on the premises, then an adult who  occupies the premises) by calling the president and making the reservation. No exceptions. The caretaker may not reserve the Clubhouse.
  6. When the Clubhouse is reserved for a party, an Adult property owner of a lot in  Haversham (or, if the owner does NOT live on the premises, then an adult who occupies the premises) must be present to act as a host/hostess. The property owner is solely responsible for the Clubhouse and pool premises.
  7. The Clubhouse and pool may not be rented.
  8. Items belonging to the Haversham Club, i.e. – pool furniture, etc., are not available for use except in the Clubhouse and pool.
  9. The Clubhouse may be reserved exclusively, but the pool cannot. However, members have always been courteous and have used discretion about swimming during a time when a fellow member has a party scheduled. In June, July, and August, no parties may be scheduled between 1:00 pm and 5:45 pm on Saturdays and Sundays.
  10. After a party, the Clubhouse and all equipment, including dishes, tables, chairs, stove, and refrigerator are to be left clean and orderly by the member using the facilities.
  11. Please observe a 30 — minute limit for the use of the ping-pong table when others are waiting to use it.
  12. No Pets are allowed in the Clubhouse or in the pool or pool area.
  13. No relative of a member of the Haversham Club may be employed as a caretaker.
  14. No member of the Haversham Club may provide services to the club in lieu of paying his/her share of dues and assessments.
  15. Each member of the Haversham Club must pay his/her monthly dues, and must pay his/her proportionate share of assessments.
  16. The President and the Treasurer may authorize the expenditure of money on behalf of Haversham. The Board of Directors must approve all discretionary expenses of Haversham of over $250.00.
  17. No member shall have authority to purchase goods or services on behalf of the Haversham Club and expect reimbursement without prior authorization of the  Board of Trustees.
  18. Trespassers in the common areas, Clubhouse or pool shall be asked to leave; if they fail to do so, they will be immediately reported to the law enforcement authorities, and The Haversham Club reserves the right to seek prosecution. Any person entering the Clubhouse or pool by breaking and entering or by climbing the fence or over the Clubhouse shall be considered a trespasser. Any person who is not a member of The Haversham Club, and who is not accompanied in the pool area or Clubhouse by a member of the Haversham Club, shall be considered a trespasser. A member of the Haversham Club who is no longer in good standing shall be considered a trespasser when using or attempting to use the Clubhouse or pool.
  19. No fighting shall be allowed in the common areas, Clubhouse or pool.
  20. If a Haversham Club member or his/her guest cause damage to the Clubhouse, pool, or Haversham Club property, that member is solely responsible and must pay for the repairs and maintenance necessitated by the damage or loss. If that member refuses to repair or replace the damage, as requested by the Board of Trustees, then the Board may make necessary repairs or replacements, and seek full reimbursements from the offending member.
  21. No bottles or other glass, china or pottery containers of any description will be allowed in the pool area.
  22. Swimmers shall not enter the Clubhouse unless their swimming suits are dry.
  23. All swimmers must wear a swimming suit. Nude swimming is prohibited.
  24. Radios and any sound systems must be kept at a low level in the pool area in consideration of other swimmers and sunbathers.
  25. For the purpose of protecting the premises, children under 14 must be accompanied by an adult at the pool and in the Clubhouse.
  26. The swimming pool shall be closed at 11:00 pm, except for private use by members only.
  27. The pool shall be closed on Tuesday s for cleaning by the caretaker. Members are hereby put on notice that the caretaker will clean the pool with chemicals on this day. DO NOT ATTEMPT TO SWIM ON TUESDAY.
  28. The caretaker shall make sure that the pool and Clubhouse are clean prior to any scheduled party. This shall include cleaning the pool area, restrooms, and Clubhouse, including cleaning the Clubhouse carpet if necessary.
  29. The caretaker may use the pool for personal use on a limited basis, and only when members and their guest are NOT using the pool. The caretaker may not have more than one guest at the pool at a time.
  30. The caretaker shall keep the large gate in front of the Clubhouse closed at all times for security purposes. The caretaker may have only one visiting vehicle parked in the drive running from Flint Ave. to the Clubhouse at one time. All other vehicles must park on Flint Ave. The caretaker shall have no vehicles coming up the drive with loud exhausts.
  31. The SAFETY of a member and his/her guests while using the Clubhouse, common areas and pool shall be the sole responsibility of that Haversham Club member, and  shall not be the responsibility of the Haversham Club or its Board of Trustees. The rules to be enforced by each Haversham Club member in regards to the Clubhouse, common areas/easements and pool are:
    1. Plastic toys only will be allowed at the pool, but should these toys deflate, they are to be removed from the pool at once;
    2. Oversized inner tubes and inflatable objects prohibited in the pool area.
    3. No double or triple bouncing off the diving board shall be allowed.
    4. No running, fighting, wrestling or unnecessary disturbances shall be allowed in the Clubhouse or pool area.
    5. No children under the age of 14 shall be allowed in the Clubhouse or pool/pool area without the present and direct supervision of an adult.
    6. The pool and Clubhouse shall remain locked at all times.
    7. Children shall use proper floatation devices suitable to their age and abilities.
    8. Children shall be accompanied and supervised by an adult in the common areas/easements at all times.
    9. Members and/or their guests should not walk alone in the common areas/easement at night. Any enforcement of these rules by the Board of Trustees, or other members, shall not be considered to create any legal duty on behalf of the Haversham Club and its Board of Trustees. Any finding made by the Board that a member is in violation of these rules and not in good standing shall not create any legal duty on behalf of the Haversham Club or its Board of Trustees.
  32. For the purpose of protecting the Clubhouse and pool against trespassers and vandalism, all persons using the pool shall make sure that the doors to the pool and the Clubhouse are closed and locked at all times.
  33. ALL MEMBERS ARE HEREBY PUT ON NOTICE THAT THE HAVERSHAM CLUB DOES NOT FURNISH A LIFEGUARD AT THE POOL. IF A MEMBER DEEMS IT PRUDENT UNDER THE CIRCUMSTANCES, HE/SHE MAY HIRE THE SERVICES OF A LIFEGUARD AT HIS/HER EXPENSE.
  34. ALL MEMBERS ARE HEREBY PUT ON NOTICE THAT THE HAVERSHAM CLUB DOES NOT FURNISH A NIGHT WATCHMAN/GUARD IN THE COMMON AREAS/EASEMENT DURING THE DAY OR NIGHT. ALL MEMBERS SHOULD TAKE PRECAUTIONS THE SAME AS THEY WOULD TAKE WHEN WALKING IN ANY ALLEY OR OTHER AREA AT NIGHT.
  35. When a vacancy occurs on the Board of Trustees, the President may appoint a person to fill the vacancy until the next Haversham Club membership meeting, at which time the membership shall vote to fill the vacancy.
  36. The caretaker and his guest are subject to each these rules to the same extent as a member, except as otherwise specifically set out herein.
  37. The pool will be opened on May 1st of each year, or as early thereafter as weather permits. The pool shall be closed on September 30th of each year, or earlier if weather requires.
  38. CLUBHOUSE RESERVATIONS: Each lot in the Haversham Addition may reserve the Clubhouse no more than twice a month during the months the pools is open, except as otherwise expressly authorized by the Board of Trustees.
